Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Found by Ikigai website, test, personalized reports, and related services available through foundbyikigai.com.

The service is operated by Found by Ikigai, based in Colombia (“Found,” “we,” “us,” or “our”).

By accessing or using the service, you agree to these Terms. If you do not agree, you should not use the service.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use Found.

By using the service, you confirm that:

• You are at least 18 years old.
• The information you provide is accurate to the best of your knowledge.
• You have the legal authority to accept these Terms.

2. The Found Service

Found provides a guided self-reflection experience based in part on the Ikigai framework.

The service may include:

• Open-ended reflection questions.
• Personalized follow-up questions.
• Automated and AI-assisted analysis.
• A preview of themes identified from your answers.
• A paid personalized report.
• Suggested reflections, questions, or practical next steps.

Found is designed to support personal reflection. It does not promise to identify one predetermined purpose, career, calling, identity, or correct path for your life.

The structure, length, presentation, and content of each report may vary based on the information provided by the user.

3. Free Test and Paid Report

You may be able to complete part or all of the Found test without payment.

After completing the test, you may be offered the option to purchase a full personalized report.

Before payment, Found will display:

• The purchase price.
• The currency.
• Any applicable taxes or fees.
• What the purchase includes.
• How the report will be delivered or accessed.
• Any material refund or cancellation conditions.

Purchasing a personalized report is optional.

The content and amount of any free preview may change over time, provided that the offer is accurately described before you begin the test or complete a purchase.

4. Report Generation and Delivery

Your personalized report is created using the responses you submit through the Found test.

The report may be generated immediately after payment or within the delivery period displayed before checkout.

The report may be:

• Displayed through the website.
• Made available through a private link.
• Sent to the email address you provide.
• Delivered through another method disclosed before purchase.

You are responsible for providing a complete and accurate email address and for checking your spam or junk folder.

If you do not receive or cannot access your report, contact foundbyikigai@gmail.com.

5. Payments

Found currently offers a one-time purchase for a personalized report.

Prices are displayed in United States dollars (USD) unless otherwise stated.

Payments may be facilitated through Wise or another payment provider displayed during checkout.

By completing a purchase, you authorize Found and the applicable payment provider to charge the payment method you select for the total amount displayed before payment.

Found does not currently charge recurring subscription fees or automatically renew purchases.

You are responsible for any taxes, currency-conversion charges, bank fees, or payment-provider fees disclosed to you or imposed by your financial institution.

6. Refund Policy

Because each report is personalized and generated specifically from the responses submitted by the user, purchases are generally final once the full report has been generated or made accessible.

A change of mind, dissatisfaction with an interpretation, or disagreement with the report’s conclusions does not automatically qualify for a refund.

You may contact foundbyikigai@gmail.com within 14 days of purchase when:

• You were charged more than once for the same report.
• You completed payment but the report was not generated.
• You could not access the report because of a verified technical problem attributable to Found.
• The report delivered was materially different from the service described before purchase.
• A refund or cancellation is required by applicable law.

Depending on the circumstances, Found may:

• Restore or renew access.
• Correct a technical problem.
• Regenerate the report.
• Provide a partial or full refund.
• Offer another appropriate remedy.

Nothing in this Refund Policy limits any consumer right that cannot legally be waived.

Any material refund conditions will also be presented before you complete the purchase.

7. No Professional Advice

Found is an educational and self-reflection service.

Found does not provide:

• Medical or mental-health diagnosis or treatment.
• Therapy, psychological counseling, or crisis support.
• Legal advice.
• Financial, tax, or investment advice.
• Employment placement or professional career counseling.
• A guarantee regarding your identity, relationships, career, future, compatibility, success, or life purpose.

The test and report are not substitutes for qualified professional advice.

You remain solely responsible for deciding how to interpret and use the information provided through the service.

If you are experiencing an emergency, a mental-health crisis, or thoughts of harming yourself or another person, contact local emergency services or an appropriate crisis-support provider immediately.

8. Artificial Intelligence and Automated Content

Some questions, summaries, interpretations, themes, and suggestions may be generated or assisted by artificial intelligence.

Found may use Anthropic’s Claude API or another disclosed AI service provider to process your responses and generate personalized content.

AI-generated content may:

• Contain factual or interpretive errors.
• Misunderstand your circumstances or context.
• Overlook relevant information.
• Produce incomplete or unsuitable suggestions.
• Reflect limitations or biases in the underlying technology.

Found does not guarantee that AI-generated content is complete, accurate, error-free, or suitable for a particular personal or professional decision.

You should review your report critically and use your own judgment.

Found does not use the service to make legal, employment, credit, housing, insurance, healthcare, or similarly significant decisions about you.

9. Your Responses and Content

You retain ownership of the original responses and content you submit.

You grant Found a limited, non-exclusive, worldwide license to host, store, process, reproduce, and transform your content only as reasonably necessary to:

• Operate the test.
• Generate personalized follow-up questions.
• Produce your preview and report.
• Deliver and maintain access to your report.
• Provide customer support.
• Maintain the security and functionality of the service.
• Comply with legal obligations.

Found may use aggregated or de-identified information that cannot reasonably identify you to understand and improve the service.

Found will not use identifiable test responses to train generalized artificial-intelligence models unless you provide separate, affirmative consent.

Your information will otherwise be handled as described in the Found by Ikigai Privacy Policy.

You agree not to submit content that:

• Violates another person’s rights.
• Is unlawful, fraudulent, threatening, or malicious.
• Contains confidential information you are not authorized to disclose.
• Contains malicious software or code.
• Attempts to interfere with or exploit the service.
• Includes another person’s personal information without authorization.

10. Intellectual Property

The Found by Ikigai name, brand, website, design, test structure, questions, software, graphics, reports, text, and other service materials are owned by Found or its licensors and are protected by applicable intellectual-property laws.

Subject to these Terms, Found grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access the service and use your personalized report for personal, non-commercial purposes.

You may download, save, print, and privately share your personal report.

You may not:

• Resell or commercially distribute the report.
• Copy or reproduce the Found test at scale.
• Extract, scrape, or systematically collect questions or content.
• Reproduce substantial portions of the service.
• Circumvent payment or access controls.
• Reverse engineer the software.
• Remove proprietary, copyright, or trademark notices.
• Use Found’s protected content to create a substantially copied competing service.

Nothing in these Terms transfers ownership of Found’s intellectual property to you.

11. Acceptable Use

You may not:

• Interfere with the operation or security of the service.
• Attempt to gain unauthorized access to an account, report, database, or system.
• Use bots, scripts, scraping tools, or automated systems without written permission.
• Upload or transmit malicious code.
• Circumvent payment, security, or access controls.
• Misrepresent your identity.
• Use the service for unlawful, abusive, fraudulent, or exploitative purposes.
• Attempt to access another user’s responses or report.
• Use the service in a manner that places an unreasonable burden on its infrastructure.

12. Accounts and Access Security

If Found offers account functionality, you are responsible for safeguarding your login credentials and for activity conducted through your account.

You must notify us promptly at foundbyikigai@gmail.com if you believe that:

• Your account has been compromised.
• Your report has been accessed without authorization.
• Your login information has been lost or stolen.

Found may require reasonable verification before restoring access or providing account-related information.

13. Availability and Changes to the Service

Found may update, modify, improve, suspend, or discontinue portions of the service.

We will make reasonable efforts to:

• Maintain access to purchased reports for the period communicated at purchase.
• Correct material technical problems.
• Avoid removing paid access without providing an appropriate remedy.

Found does not guarantee that the website will always be uninterrupted, available, secure, or error-free.

Temporary interruptions may occur because of maintenance, technical failures, security events, third-party providers, or circumstances outside our reasonable control.

Material changes will not eliminate rights to a purchased report without an appropriate remedy where required by law.

14. Third-Party Services

The service may rely on third-party providers, including:

• Payment providers.
• AI service providers.
• Hosting and cloud-infrastructure providers.
• Database providers.
• Email-delivery providers.
• Security and technical service providers.

Third-party services may be governed by their own privacy policies and terms.

Found is not responsible for the independent acts, content, availability, or practices of third-party services that it does not control.

15. Disclaimers

To the maximum extent permitted by applicable law, the service is provided on an “as is” and “as available” basis.

Found does not guarantee that:

• The service will always be available or uninterrupted.
• Every technical error will be corrected immediately.
• The report will identify a specific life purpose, career, or personal outcome.
• The report will meet every user’s expectations.
• AI-generated interpretations will always be accurate or complete.
• Using the service will produce any particular personal, professional, financial, relationship, or career result.

To the maximum extent permitted by law, Found disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

These disclaimers do not exclude any warranty or consumer right that cannot legally be excluded.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Found and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the service.

This includes losses resulting from personal, relationship, professional, financial, educational, or career decisions made in reliance on the test or personalized report.

Found does not guarantee any particular result, improvement, opportunity, relationship, career path, decision, or life outcome.

Nothing in these Terms excludes or limits liability for:

• Fraud.
• Intentional misconduct.
• Gross negligence.
• Any responsibility that cannot legally be excluded or limited.
• Any non-waivable consumer-protection right.

This section does not prevent you from requesting a refund or another remedy when Found fails to deliver a purchased service as required by applicable law.

17. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, or reasonable expenses directly resulting from:

• Your unlawful or fraudulent use of the service.
• Malicious code or attacks introduced by you.
• Content you submit without the necessary rights or authorization.
• Your infringement of another person’s intellectual-property or privacy rights.
• A material violation of these Terms.

This section does not require you to compensate Found for claims caused by Found’s own unlawful conduct, negligence, or breach of these Terms.

18. Suspension and Termination

Found may suspend or terminate your access when reasonably necessary because:

• You materially violate these Terms.
• You attempt to compromise the service.
• You engage in fraud or abusive activity.
• Your activity creates a material security or legal risk.
• Suspension is required by law.

Where appropriate, Found may provide notice and an opportunity to correct the violation.

You may stop using the service at any time.

Sections concerning intellectual property, disclaimers, limitations of liability, payments, disputes, and other provisions that should reasonably survive termination will remain effective.

19. Governing Law and Consumer Rights

These Terms are governed by the laws of the Republic of Colombia, without regard to conflict-of-law principles.

However, if you are a consumer, nothing in these Terms limits any mandatory consumer-protection rights that cannot legally be waived under the laws applicable in your state, country, or place of residence.

The application of Colombian law does not prevent a consumer from contacting or filing a complaint with a consumer-protection authority that has jurisdiction under applicable law.

20. Informal Dispute Resolution

Before filing a legal claim, you agree to contact Found at foundbyikigai@gmail.com and provide:

• Your name.
• The email address associated with the purchase.
• A description of the issue.
• The remedy you are requesting.
• Any relevant supporting information.

Found and the user will make a good-faith effort to resolve the issue informally.

This informal process does not prevent you from:

• Exercising a legal right within an applicable deadline.
• Requesting a charge correction or legally available payment reversal.
• Filing a complaint with a consumer-protection or data-protection authority.
• Seeking urgent relief.
• Using any remedy that cannot legally be restricted.

If a dispute cannot be resolved informally, it may be brought before a court or competent authority with jurisdiction under applicable law.

21. Changes to These Terms

Found may update these Terms to reflect changes to the service, business practices, providers, or applicable law.

The revised Terms will be posted with an updated effective date.

Material changes will apply prospectively unless otherwise required by law.

When legally required, Found will provide additional notice or request your consent before a material change applies.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

The invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable, where permitted by law.

23. Entire Agreement

These Terms, together with the Privacy Policy and any purchase-specific terms displayed before checkout, constitute the entire agreement between you and Found concerning the service.

If purchase-specific terms conflict with these Terms, the purchase-specific terms will control only with respect to that purchase.
